COBRA Premium Subsidy Denial Appeals Procedure

The U.S. Department of Labor has released the COBRA Premium Subsidy Denial Appeals Procedure for qualified beneficiaries to follow if they have been denied a request to be treated as an Assistance Eligible Individual. It contains instructions for the person to follow and provides an online application process for the individual to complete and submit to the DOL for review.


To file the appeal, the qualified beneficiary will need the following information to be able to complete the application successfully.
  • COBRA election notice;
  • Information on your plan sponsor, employer, insurance company, and/or plan administrator;
  • A "Request for Treatment as an Assistance Eligible Individual" or other form used to request the premium reduction;
  • Insurance information card;
  • Payroll stubs showing deductions for health benefits;
  • Any documents detailing the date and circumstances of the termination of the employee’s employment; or
  • Any documentation you were provided regarding the denial of the premium reduction
